If you reside in the United States and received written notice from Etairos Health, Inc. (“Etairos”) about a data incident that occurred on or around February 20, 2024, during which during which an unauthorized individual was suspected to have potentially accessed Etairos’ systems and acquired Personally Identifiable Information (“PII”) of Etairos’ current and former employees (the “Data Incident”), you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (i) Etairos and its officers and directors; (ii) all Settlement Class Members who timely and validly request exclusion from the Settlement Class; (iii) the Judge assigned to evaluate the fairness of this settlement; (iv) the attorneys representing the Parties in the Litigation; and (v) any other individual found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity involved in the Data Incident or who pleads nolo contendere to any such charge.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by December 21, 2026.

The Settlement will provide free credit monitoring services and cash payments to people who submit valid claims or an alternative cash payment of $75.00 in lieu of a claim for reimbursement.

Credit Monitoring Services. All Class Members are eligible to enroll in three (3) years of three-bureau credit monitoring and identify theft protection under the settlement that will include a minimum of the following features:

  • dark web scanning with user notification if potentially unauthorized use of a Class member’s personal information is detected

  • identity theft insurance

  • real time credit monitoring with Equifax, Experian or TransUnion

If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.

Attested Time. Class Members who spent time remedying issues related to the Data Incident may claim up to eight (8) hours, at $15.00 per hour, for a maximum of $120.00. You must have spent the time on tasks related to the Data Incident.

Out-of-Pocket Losses. Class Members who incurred actual, documented out-of-pocket expenses due to the Data Incident, can get back up to $4,500.00. The losses must have occurred on or after February 20, 2024, through December 21, 2026, and cannot have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:

  • costs incurred on or after February 20, 2024, associated with accessing or freezing/unfreezing credit reports with any credit reporting agency;

  • credit monitoring or other mitigative costs that were incurred on or after February 20, 2024, through the date of the Class member’s claim submission;

  • unreimbursed costs, losses, or expenditures incurred as a result of identity theft or identity fraud, falsified tax returns, or other possible misuse of the Settlement Class Member’s personal information; and

  • other miscellaneous expenses incurred related to any Out-Of-Pocket Loss such as notary, fax, postage, copying, mileage, and long-distance telephone charges

You need to submit documented proof, like bills or payment card statements, to show how much you spent or lost. You may redact unrelated transactions and all but the first four and last four digits of any account number. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Incident.

Alternative Cash Payment. In lieu of making a claim for Out-Of-Pocket Losses and Attested Time, Class Members may claim a one-time payment of $75.00.

The deadline to submit a Claim Form online is December 21, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than December 21, 2026.
